The decision is an interim injunction and Bethesda has the right to appeal. As much as I like and support Bethesda I hope they either give up or lose. Scroll? A trade Marked word? Silly in my opinion. I could understand their suing if some used "The Elder Scrolls" but the simple word 'scroll'?

My advice? Think of it as a marketing ploy on the part of both companies and don't worry about it too much. The watch word for marketing is: There is no such thing as bad publicity.
(I've learned a lot about that while working for my brother. He was "sued" twice by Gary Gygax (D&D). Didn't hurt at all. Also, our flagship game, Nuclear War, was brought up in Britain's Parliament once with the intention of banning it. Both episodes added welcome publicity and much needed money to his company.)

 You are right. I said something similar when someone posted that Skyrim had been rated Mature here in the USA. Update: I heard from a poster that Notch at Mojang was the one who tried to trade Mark the word Scrolls. I suspect that he knew exactly what he was doing. He got the names Minecraft and Quake some good publicity.
